HAVEN IN PARIS TERMS AND CONDITIONS

(These are the exact terms you will agree to when signing the Haven in Paris rental agreement to secure your rental).

What you need to do to Secure a Reservation with Haven in Paris

Thank you for your interest in our properties. In order to secure a reservation, we will send a rental agreement with all of the information you need to firm up your booking.

For your information:

  • All final Euro rates will be converted to dollars the day you reserve
  • You can see updated currency conversions at: xe.com
  • Our rate is all inclusive, there are no extra taxes or fees
  • If we are more than 2 months before your arrival date, we would require a 50% deposit to book the apartment
  • If we are less than 2 months before your arrival date, we would require 100% payment to book the apartment.
  • We accept checks, wire transfers, MC, Visa & AMEX.

RENTAL TERMS AND CONDITIONS

Rental period

Rental begins: 4 p.m. on arrival date

  • If no one has vacated the morning you arrive, you may check in as early as you like. (Please check on apartment calendar and/or with us closer to your arrival to see if someone is leaving or not that morning.)
  • In the case that someone has just vacated, we understand that you will want to check in immediately and will try to be as accommodating as possible. Officially check in is 4pm, nevertheless, your greeter will meet you at the property as early as 10 am (sometimes earlier, please ask) to allow you to drop off luggage. At this time will tell you when the maid will be finished and ask you to return at that time. * Please be aware that Maids cannot appropriately clean when guests are in the property.
  • If you would like the property to be completely cleaned and ready for an early morning arrival, we suggest you reserve from the previous day.

Rental ends: 10 a.m. on departure date

  • If your flight is later in the day and other clients are arriving immediately after you, we will check you out by 10am, arrange for you to leave your luggage, and have you come back while cleaner is still cleaning.
  • If no-one is arriving the day you leave we will be happy to arrange your check out accordingly, but when necessary, the maid may need to arrive as early as 10am, to clean.

Rental price

Rental prices are in $USD converted from euros on the date the contract is established at www.xe.com/ucc. Renter agrees that all payments will be made in US$ Dollars based on this rate.

The rental price includes:

  • Occupancy of property for specified time period.
  • Flowers & Wine upon arrival.
  • All taxes, utilities, and local telephone service
  • Bed linens and towels
  • Guide with detailed local recommendations.
  • Housecleaning once a week after a week for stays of 2 weeks or longer.
  • ( Extra cleaning can be arranged for a fee. Please inquire as far in advance as possible )
  • CONCIERGE SERVICE IS AVAILABLE FOR EXTRA FEE. PLEASE INQUIRE
  • Phone in Paris:

a. FREE Unlimited calls from Paris to Land lines & Cell phones in: USA & Canada

b. FREE Unlimited calls from Paris to Land lines in: New Zealand, Australia, UK, China, Taiwan, Singapore, France, Germany, Belgium, Austria, Cyprus, Denmark, Spain, Estonia, Finland, Greece, Holland, Hungary, Ireland, Italy, Lithuania, Luxembourg, Malta, Poland, Portugal, Czech Republic, Sweden, Slovenia, Slovakia

  • In France Cell phones (#'s that start with 06) are NOT free to call and can be quite expensive; please try to limit calls to 06 numbers from the apartment. We appreciate this courtesy.
  • Some of the apartments have different phone service providers, if there is a country you need to call, please re-confirm to make sure it is indeed free in the flat you are renting (except US, CA, NZ, AU, UK, & Europe as these countries are free in all apartments)
  • True for all Paris apartments except La Tour Maubourg which only has local phone service.

In Provence and Tuscany the villas mainly offer local phone service. Please ask for specific details as these things do evolve.

Payment

Rental start date is more than two months from date of signing RA:

a. Fifty percent (50%) of total rental price is due.

No rental is confirmed until you, the renter, accept the RA and terms and conditions, and your card is charged (or you fax us a copy of check or wire for the appropriate price). Lastly, to finalize and secure your reservation, we will need a Scanned/Faxed Credit Card authorization form for all security deposits by credit card.

b. The balance of the rental is due two months before arrival. If the balance has not been paid by this date, we reserve the right to cancel your booking, void your contract, and retain your initial payment.

Rental start date is less than two months from date of signing RA:

One hundred percent (100%) of total rental price is due.

No rental is confirmed until you, the renter, accept the RA and terms and conditions, and your card is charged (or you fax us a copy of check or wire for the appropriate price). Lastly, to finalize and secure your reservation, we will need a Scanned/Faxed Credit Card authorization form for all security deposits by credit card.

Occupancy

Renter agrees that the number of people occupying property at one time will not exceed maximum occupancy number indicated on RA.

  • Group size is determined at time of reservation & is indicated above. Owners are not responsible for any problems arising during a rental where these terms are not respected.
  • If extra people will be occupying property please alert us and pay extra fees when applicable.
  • Renter will personally occupy property for said dates and not sub-let under any conditions.

Renter agrees to be quiet and respectful of neighbors at all times. This includes no excessive noise in property, stairwells, elevators, or building entry. People living here are not on vacation. Please act how you would want them to act in your own home.

Smoking

Renter agrees not to smoke or allow visitors to smoke inside Property. We do our best to provide completely non-smoking properties and thank you for your consideration.

* Feel free to smoke on balcony, in garden or courtyard (when applicable).

Cancellation by Client

In the event of a cancellation, ALL sums paid to HIP as of the date of such cancellation shall be forfeited unless HIP is able to re-rent property for the same period, in which event, the amounts paid, less a 20% administrative fee will be refunded to Renter.

Cancellation Insurance is the Renter's personal responsibility. We strongly recommend that you take out cancellation insurance for your trip. HIP will not be held responsible for cancellations for ANY REASON. It is hard to believe it will happen to you but sometimes life has a way of changing our plans for us. Please protect yourself.

* If you change your travel dates this becomes a new rental.

Cancellation by Haven in Paris *

In the unlikely event that HIP is unable to provide you, the Renter, with the property originally booked, we reserve the right to offer you:

  • a property of equal or greater value in exchange. If the property is of greater value, you will be asked to pay the difference OR if this is unacceptable, you will be given a 100% refund
  • If the only thing available is a smaller property of lesser value, you will be given the choice of taking it with a refund for the difference in price from your original booking OR if this is unacceptable, you will be given a 100% refund
  • If nothing is available for your dates, we will cancel the booking and immediately give you a full refund

Possible reasons for cancellation by HIP would include, but not be limited to: Damage to apartment, Flooding, Fire & Major construction on building or environs.

Lost Key

If you lose the key, for your security, we are usually required to change lock. Renter agrees to pay this cost. A bill will be provided before card is charged. It is often quite expensive (600 - 1000 euros depending on specific lock) to change locks in Europe. Please be very careful with keys.

Renter agrees to inform Greeter, HIP, Owner or Owner's representative immediately of any damages that occur during stay.

Equipment Breakdowns

HIP/Property Owners cannot be held responsible, at any time, for breakdown of mechanical equipment in rental or common area of the building (heat, elevator, electricity), nor for failure of public utilities (water, gas, cable, electricity). Please alert Greeter or HIP of any problem AS SOON as it is identified. Every effort will be used to rectify it in a timely manner. If we are not informed of a problem we cannot resolve it for you. If you feel that the matter is not resolved in a timely manner, please contact HIP by phone or email.

Internet Computer Note: Working Internet connections are provided (Ethernet Cables and/or Wireless Internet) in all Paris properties and working computers are provided in all of the Paris properties except Left Bank Luxe/ rue du Four and La Tour Maubourg/rue Cler Market. HIP/property owners will do our best to keep everything in good working condition. If you wish to connect your computer up to our network, please have all of the connection codes and information necessary for you to connect. HIP/property owners cannot be responsible for Renter's inability to connect to a working Internet connection. If this were to occur, we can provide the name of a computer tech person who can set up the connection for you, at your own expense. (At this time Four & Maubourg do not have computers in them.)

Please note: Internet connections in Europe are not always reliable. HIP/Property owners cannot be held responsible for a non-functioning Internet connection (or computer**), but will use all means possible to remedy the problem as soon as possible.

**If computer use is essential during your stay in our property, we would suggest that you bring along your own, as we would not want your stay to be ruined due to the malfunction of the computer in your property.

For rentals in Provence and Tuscany, please inquire and we will let you know what kind of connection is in the villa, and if there is a computer available for your use.

Cleaning

The property will be thoroughly clean when you arrive and we ask that you leave it tidy when you depart. If upon arrival there is any issue of cleanliness PLEASE NOTIFY Greeter or HIP As Soon as Possible so they can take care of the situation immediately.

Personal Liability & Liability insurance

Absent gross negligence or willful misconduct, Renter agrees to fully release both Haven in Paris and any representative, Owner, and Owners' representative from any and all claims (in contract, tort, or otherwise) for liability and damages to tangible or intangible personal property or personal injury occurring to the Renter or third parties on the premises during the rental period indicated in this rental agreement. Please make sure your personal or travelers insurance will cover you in the unfortunate event that you injure yourself in the property or if you become ill during your stay.

In event of theft or damage to person or personal belongings, HIP/Owner undertake no responsibility whatsoever for direct or indirect harm suffered. All valuables left in property are done so at your own risk. All measures haven been taken to ensure that the rental property is secure, but it is your responsibility to make sure proper precaution is taken against theft and burglary.

In addition, Renter agrees to indemnify HIP, Owner or Owner's representative, for all costs, direct or indirect damages, punitive damages or other liability incurred by HIP, Owner, or Owner's representative, resulting from any act or omission by Renter in connection with this rental.

Renter agrees that HIP and Owner's liability for all claims, of any kind, arising out of this engagement shall be limited to the total fees paid by Renter to HIP on this engagement.

No action, regardless of form, relating to this Agreement or any associated engagement or service, may be brought by either party more than six months after the cause of action has accrued, except that an action for non-payment may be brought not later than one year following the date of the last payment due to the party bringing such action.

The parties agree that in no event shall either party's aggregate liability hereunder for any cause arising out of or related to such Party's performance or non-performance, monetary claim or legal action, exceed the amount of the fees paid hereunder under the particular rental agreement, excluding gross negligence or willful misconduct.

Interpretation of Contract

In the event of any dispute, this Contract will be construed as a whole, will be interpreted in accordance with its fair meaning, and will not be construed strictly for or against either Client or HIP. The parties agree that a facsimile of this Contract or an Attachment thereto is as valid as an original copy. This Contract shall be governed by and construed in accordance with the laws of Massachusetts.

Jurisdiction

This contract is governed by the laws of the Commonwealth of Massachusetts. Courts in Massachusetts have exclusive jurisdiction over any claims, disputes, or other matters in question between the parties. In the event of litigation, the party found to be in breach of this Contract shall pay all court costs & reasonable attorney's fees for the non-breaching party.

No action, regardless of form, relating to this engagement, may be brought by either party more than 6 months after the cause of action has accrued, except that an action for non-payment may be brought not later than one (1) year following the date of the last payment due to the party bringing such action.

Invalid Provisions

In the event that any part or provision of this Contract shall be determined to be invalid or unenforceable under the laws of the State of Massachusetts, the remaining portions of this Contract which can be separated from the invalid, unenforceable provisions shall nevertheless continue in full force and effect.

Voluntary Execution

Each party acknowledges that they (with the intent to become legally bound by executing this Agreement) fully understand the Agreement and its legal effect, and that this Agreement may be signed only by Renter as a Unilateral Contract. Such party is signing the Agreement freely and voluntarily. For purposes of this Agreement, a "Unilateral Contract" shall be defined as binding upon the following act; payment made by Renter and accepted by Hip in anticipation of the Rental Services to be provided at a later agreed upon date as defined above.

Each party may consult an independent attorney to ensure that the party's rights have been protected. Each party also acknowledges that the party is not relying on any representations made by a representative of the other party concerning any aspect of this Agreement.

Immediate Force and Effect

This Contract shall be in force and effect immediately upon its execution.

HAVEN IN PARIS PRIVACY STATEMENT

  • Protecting the privacy of our clientele is extremely important to Haven in Paris. This is an obligation that we take very seriously. We are committed to protecting all of your personal information.
  • At Haven in Paris we will never release your personal data, such as your name, address, phone number, email address, etc without your consent. We do not rent, sell or distribute any part of your information collected to any third party organization.
  • We only use your information to complete your orders and for our own personal statistics (which we do not give to anyone).
  • All credit card information is kept confidential and safeguarded by our secure server.
